Provider and scope
These template terms concern use of the website operated by [Company name and legal form], [Address], and non-binding enquiries about the Monetary Metalls EU project. The binding version and its scope must be determined before any contract is concluded.
Subject of the concept
The concept combines the purchase of physical gold with its contractually agreed provision to a lessee in return for remuneration. Ownership allocation, custody, location of use, return, security arrangements and the parties' roles are governed exclusively by the specific contracts. The name Gold Yield Account does not denote a bank or deposit account.
Enquiry and information meeting
Website content is a general presentation of the concept. A locally created enquiry is neither an investment order nor acceptance of a contract and is not transmitted automatically. An information meeting is non-binding. A contract arises only after all required documents have been supplied and separate valid acceptance has taken place under [Contract formation procedure].
Product terms and remuneration
Term, leasing remuneration or interest rate, calculation basis, payment dates, fees and settlement currency are specified in the relevant product sheet and agreement: [Dated product sheet]. “From EUR 25,000” and “up to 8.00% p.a.” describe the concept's intended entry amount and target remuneration; they do not replace a binding offer. Costs and taxes may reduce net returns.
Scope of services and advice
The website provides no individual investment, legal or tax advice and promises neither a specific return nor preservation of capital. Planned EU custody and any insured welcome gold will be defined by agreed service terms. Insurer, scope of cover, exclusions and persons entitled to claim must be identified separately. Insurance is not a general capital guarantee.
Withdrawal, termination and availability
Statutory consumer rights remain unaffected. Whether and in what form a right of withdrawal exists depends on the contract type and applicable law; the specific notice is: [Withdrawal notice]. Ordinary and extraordinary termination, expiry, return or payment and any costs: [Contractual provisions]. Availability at any time is not promised.
Liability
This template contains no blanket exclusion of liability. Liability for intentional conduct, gross negligence, harm to life, body or health and other mandatory statutory liability remains unaffected. Permissible provisions for other situations, particularly breach of essential contractual obligations, must be drafted according to the final services and applicable law: [Liability clause].
Final provisions
Applicable law: [Jurisdiction]. Mandatory consumer protections remain unaffected. Place of jurisdiction, where validly agreed: [Place]. Contract language and authoritative language version: [Details]. Consumer dispute resolution participation: [Competent body and participation details]. Individual agreements and mandatory law take precedence.
